HIGH ALERT!
The Baby Food Safety Act of 2024 has a preemption that would eliminate all previous state laws regarding any contaminant in any food AND stop us (and other organizations or states) from testing, disclosing results, and you, the public, knowing what contaminants are in our food.
Preemption of State and local requirements regarding food ingredients and contaminants in food, including infant and toddler food.
No State or political subdivision of a State may establish or continue in effect with respect to contaminants in food, including infant and toddler food, food pouches made with fruit or vegetable puree or juice, and juice, any requirement that is different from, or in addition to, or not identical with any requirement under this section, and relates to contaminant sampling and testing, contaminant limits, disclosure of contaminant test results, contaminant labeling, contaminant warnings, or any other matter related to contaminants in food.
This preemption is similar to the Farm Bill preemption that disallows states from restricting or banning pesticides. And a new bill, such as the one in Iowa, SF 2412, will stop farmers from suing chemical companies for health effects such as Parkinson’s disease, which has been closely linked to paraquat, rotenone and other agrochemicals.
The fact is that corporations are lobbying to push policy through our government to benefit them, not us. These preemptions are extremely dangerous to public health. All of our loved ones and community members are and will be affected.
This is an emergency situation, and we need to get to DC as soon as possible in September to prevent these preemptions from being included in the bills.
If we lose our ability to test, share information, and inform the public what is in our food, the public will have no way of knowing the truth and protecting their families. We will not be able to hold food manufacturers accountable for food safety. Americans will continue to be poisoned by toxic food.
If farmers cannot sue and hold chemical companies accountable for their harmful chemicals, other farmers will not be able to determine whether their injuries were also connected to agrochemical use, and will continue to be harmed. Our society can only exist with healthy farmers, soil, water, and food.
As a 501c3 non-profit, Moms Across America can only allot 20% of our budget and time to legislation matters. We need to be highly selective. Addressing this Baby Food Safety Act preemption and Farm Bill preemption is crucial.
We must also educate our elected officials about the dangers of using glyphosate and other agrochemicals as drying agents. It is this practice that is responsible for:
- Harmful levels of glyphosate and heavy metals in practically every nonorganic meal, beverage, and baby formula. Even some organic food and beverages are contaminated with low levels that are also harmful.
- Increased exposures to glyphosate and agrochemicals result in neurological disorders, nervous system damage, and gut microbiome disruptions, which weaken the immune system, contribute to chronic disease and cancer, and disrupt hormone production. These effects are major contributing factors to our mental, physical, and reproductive health crises.
- Glyphosate contributes to livestock illness and increased antibiotic use, which increases mRSA and antibiotic resistance, causing hundreds of millions of dollars of livestock loss, human illness and death.
- Glyphosate contamination in pet food and glyphosate use in neighborhoods contribute to pet cancer, billions in expenses, and devastating early pet death. An owner cannot sue pet food or medication manufacturers or pesticide applicators for pet deaths.
- Heavy metal and agrochemical contamination contribute to reduced trust in American exports to other countries, loss of revenue, and dissolution of trade agreements, leading to instability as a world power.

In addition, will you please contact your Senator and Representatives and tell them to support our health, not the profits of the baby formula and chemical corporations? Tell them to include baby formula in the Baby Food Safety Act, and to take out the preemption in both the Baby Food Safety Act and the Farm Bill. Thank you!
